In 2017, the Supreme Court of India declared ‘instant Triple Talaq’ unconstitutional. The government enacted the Muslim Marriage Protection Act in 2019 by calling ‘Triple Talaq’ null and void.
The man practicing so may get imprisonment for up to a term of three years.
Irrespective of such stringent laws and punishment, ‘Triple Talaq’ is still being practiced in the Muslim community. Cases of this nature are being reported every other day.
In the latest such case from the Indore district of Madhya Pradesh, a woman was given ‘Triple Talaq’ by her husband through text message. He sent her a text reading ‘Talaq Talaq and Talaq’.
After she read the text, their marriage turned null and void in the man’s eyes.
Rashtra Jyoti called up the Khajrana police, under whose jurisdiction the case has been reported from, on 20 January. The Investigating Officer for this case, Manish Dangi, said that a case (number—42/2023) has been registered against the accused husband, and the police teams are trying to locate him.
She added that the police teams will leave for Ajmer soon. The man is a native of Ajmer and is currently living there.
He has been booked under IPC sections 498 (enticing or taking away or detaining with criminal intent a married woman) with sections 3 and 4 of the Muslim Marriage Protection Act, 2019, he said.
As per a report by Amar Ujala, the woman, Nilofar, complained to the police that her husband Imran Mohammad first pronounced ‘Talaq’ thrice on a phone call and then sent her a text reading the same.
She added that her husband was already married and still he lured her into a relationship with him. They met through a social media application for marriages.
Imran lives in Ajmer and they got married to each other in November 2020. Soon after marriage, disputes began and he left her. Recently he called her and gave her talaq.
Officer Dangi told the media a few days ago that the woman was already married twice before getting married to Imran. She has three children from her previous marriages. Imran agreed to take care of them, but now he gave her ‘Triple Talaq’.

Two months ago, another such case came to light from Indore where the husband gave ‘Triple Talaq’ to his wife. A case (number—1022/2022) was registered at the Chandan Nagar police station of the Indore district.
As per a report by Dainik Bhaskar, Waseem Shah gave ‘Triple Talaq’ to his wife eight years after their marriage. When she said she wanted to live with him, he put up a demand for ‘Halala’. When other family members talked to him, he decided he will accept her again. But when the woman reached his house for settlement with her parents, he discarded her saying he will never accept her again.
Another case was reported from Indore last year where a husband gave ‘Triple Talaq’ to his wife just because he wanted a son and she had given birth to a girl child. Nazma filed a case against her husband Altaf at the same Khajrana Police station.
In another incident reported in Indore, one Alisha filed a case against her husband Mudassar Khan, a businessman, who gave Triple Talaq to her. Mudassar had given Triple Talaq to another woman to marry Alisha.
In yet another case, Alina got married to Mohammad Aas who gave her ‘Triple talaq’ after she gave birth to a girl child. As reported by Amar Ujala, Aas divorced her on a phone call.
